TRAVEL IDENTIFICATION
- One of the following Identification Methods below (1 or 2) is required for cruise travel.
- Either of the following are acceptable, although Non-US Citizens MUST use a Passport.
- Flying to another country (some Resort Stays and oversea's cruise departure ports) will REQUIRE a Passport.

BACKGROUND CHECK
This contract serves as the Staff Member’s approval for Autism on the Seas to submit to a criminal and sex offender’s background check prior to the cruise/resort stay and acceptance of this contract by AotS.

Pregnancy Policy
Cruise lines have a Pregnancy policy, which you need to agree to now (below). You will also be asked to agree to this again closer to the cruise.
Physical Limitations
GENERAL PHYSICAL/MEDICAL LIMITATIONS
- Unable to participate in physically rigorous activity such as Bumper Cars and Trampolines.
- Unable to assist and participate in caring for very active children that often require staff to engage them physically: playing on the floor, dancing, using typical playground equipment, ect.
- Unable to provide my undivided attention during all required volunteer time (assisting guests) due to a disability of any kind, or due to a disability assistive device (including hearing impairment devices, service animals, walk assist devices, etc).
- Unable to successfully and fully complete Day 1 of the cruise that will begin at 7:00am (staff meeting) and end roughly at 10:00pm, with minimal breaks (roughly an hour or so total). This will require a mix of meetings, standing often waiting for and guiding guests through port terminal and at venues on the ship.
- Unable to participate in an activity that would conflict with an allergy or aversion
- Any restrictions due to pregnancy (if applicable).
RUNNING LIMITATIONS
- Unable to RUN after a guest who may have eloped/ran away
- Unable to PLAY on the FLOOR with a guest, then GETTING UP from the floor and RUNNING after a guest WITHIN A COUPLE OF SECONDS without ANY difficulty
SWIMMING ASSIST LIMITATIONS
- Unable to assist others Swimming (mostly in shallow areas of pools and beaches)
BUNKING
Staff may end up in a cabin with a top bunk (like bunk beds). If you have any limitation that will prevent you from using the short ladder and/or the ability to get into and down from a top bunk/using a top bunk please indicate that here.

Staff Conduct
This contract requires staff member to conduct themselves in the following ways before, during or after any cruise/resort stay, including time frames between multiple cruises/resort stays.

Staff Terms
Audio/Visual Permission
Staff member gives permission for AotS to reproduce through the following, the image or voice of the staff member during their participation in the Cruise:
- The use of still photography in Autism on the Seas promotional printed literature.
- The use of video, voice or still photography in Autism on the Seas television, radio, webinar, website, Facebook page, or any internet related medium.
- The complete confidentiality of all audiovisual materials will be maintained and that these materials will only be used for the purposes indicated above.
Cabin/Room Mates/Travel Companions
- Staff Member is willing to share a cabin with up to 3 other staff / 4 max staff per cabin (but typically it is 2 or 3 per cabin).
- Staff members who are dating, co-habituating or married are not permitted to share a cabin/room.
Cancellation/Refunds
- Cancellation by the Staff Member must bemade by submitting this form: https://autismontheseas.com/staff-contract-cancel
- The date of Staff cancellation is the date Autism on the Seas receives the form (above) submission.
- If Autism on the Seas cancels the Staff Member from this AotS Cruise for any reason, after the Staff Member signs and submits this contract, Autism on the Seas will reimburse the Staff Member the equivalent monetary value of the cancellation fees for their airfare only, if any, to a maximum of $400.00.
- Any rebates, refunds, discounts, etc. offered/provided by cruise line, not due to personal injury or isolated incidents to staff member will be used by AotS for future staffing needs and is not to be used by or for staff members personal use.
Compensation / Costs / Tips
- In exchange for the Staff Member’s volunteer assistance onboard this cruise/resort stay, AotS will pay for the Staff Members cruise fare/resort stay in full, including all fees and taxes.
- Transportation to and from the staff hotel the day of departure, to/from the cruise port of departure (although, complimentary transportation will be provided from Staff Hotel to Cruise Port the day of cruise departure, if desired) and any onboard purchases are the responsibility of the staff member.
- The Staff Member understands and acknowledges that volunteer positions are unpaid positions and compensation other than gratuities from guests (not AotS) is not provided.
- All tips collected from the families at the end of every cruise are pooled and divided amongst each staff member, except for 1:1 staff (1:1 staff are not included in the general Tip Pool).
- Any tip a staff member receives directly from a family is for the staff member to keep and is not pooled.
- Staff member will be obligated to pay: Cruise Line Gratuities (approx. $10-15 per day but may alter this as they see fit based on the service they receive from cruise line staff).
- Staff member will be obligated to pay: Any transportation to beaches (during AotS beach excursions, typically no more than $20-$50 per cruise).
- AotS will provide a monetary (major retail chain or equivalent) credit to aid in off setting some out of pocket expense to the volunteers
- Staff member understands what is included and not included in the cruise fare via the cruise line websites.
Disclaimer, Notification & Contract Binding Date
- This contract will become legally binding by both parties effective once this document is signed by the Staff Member.
- Any associated costs or cancellation fees of any Travel plans the Staff member makes (airfare, rental vehicle, hotel, etc.) are not part of this contract and are not the responsibility of AotS, except as stated in this document under “Cancellation”.
- AotS is not liable for any fees or costs associated with ANY plans or services purchased by the Staff Member prior to the signing of this document and submittal/acceptance to AotS.
- The Staff Member acknowledges that Autism on the Seas policies and procedures are subject to change at any time with or without notice.
Duties Onboard / Free Time
- Staff member will assist in setting up the events during the Cruise.
- Staff member is required to assist with all “respite” sessions during the cruise and all AotS functions caring for/assisting the children, teenagers and adults with developmental disabilities.
- Staff member is required to assist the families with meals, 3 times per day (from 45 minutes to 1.5 hours each).
- At least one Port day will be free time for the Staff Member. We provide support to families at a beach, in the mornings (twice at a maximum), and when the port of call is one of the cruise lines private islands, we may also provide respite time in the afternoon. There may be some exceptions to this policy and staff may be asked to volunteer for a specific function during a port day. The final schedule will be provided onboard the cruise and is subject to change.
- Staff members will be required to work selected functions such as crafts, bingo, movie time, pool time, ship entertainment venue time, etc. although some functions may not require all staff and staff may be rotated depending on the venue and staff to child ratio. The final schedule will be provided onboard the cruise and is subject to change.
- Staff member’s responsibility to AotS typically begins at 8:00am and ends nightly at the end of our respite session, normally 10:00 pm. Periodic breaks are provided throughout the day on Sea Days. Average amount of time on duty varies each day but averages out to roughly 9 to 10 hours per day, over a 14-hour period.
- Staff member is free to enjoy the ship activities and venues when they are not scheduled to work.
- Although staff day off (if offered) we do provide evening respite every night, so staff are cautioned to enjoy their day off responsibly.
Guest Special Needs Information / Confidentiality
Staff member will receive information on all the special needs children/adults that will be traveling, prior to the cruise. This detailed information is provided to us through a questionnaire completed by the parent/guardian for each special needs children/adults, and is and must be held in the highest confidential regard and will not be shared with anyone not employed or a volunteer of AotS.
Release of Liability
Know Ye, That I, Staff Member, hereinafter designated as the Releasor, does remise, release and forever discharge the release Autism on the Seas, Michael Sobbell, Autism on the Seas, it’s agents, servants, cruise lines, vacation supplier, employees, and volunteers from all debts, obligations, reckonings, promises, covenants, agreements, contracts, endorsements, bonds, specialties, controversies, suits, actions, causes of actions, trespasses, variances, judgments, extents, executions, damages, claims or demands, in law or in equity, which against the said Releasee, the Releasor ever had, now has or hereafter can, shall, or may have, for, upon or by reason of any matter, cause or thing whatsoever, from the beginning of the world to the day of the date of these Presents. More particularly, for any and all claims against Autism on the Seas, it’s agents, servants, employees, volunteers, cruise lines, vacation supplier, or any other individuals associated with Autism on the Seas during this Cruise. Wherever in this instrument any party shall be designated or referred to by name or general reference, such designation is intended to and shall have the same effect as if the words "heirs, executors, administrators, personal or legal representatives, successors and assigns" had been inserted after each and every such designation and all the terms, covenants and conditions herein contained shall be for and shall inure to the benefit of and shall bind the respective parties hereto, and their heirs, executors, administrators, personal or legal representatives, successors and assigns, respectively. In all references herein to any parties, persons, entities or corporations the use of any particular gender or the plural or singular number is intended to include the appropriate gender or number as the text of the within instrument may require.
Communicable Diseases - In consideration participating in the Autism on the Seas functions, events and activities, the undersigned acknowledges, appreciates, and agrees that:
1. Participation includes possible exposure to and illness from infectious diseases including but not limited to MRSA, norovirus, influenza, and COVID-19. While particular rules and personal discipline may reduce this risk, the risk of serious illness and death does exist; and,
2. KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES or others, and assume full responsibility for my participation; and,
3. Willingly agree to comply with the stated and customary terms and conditions for participation as regards protection against infectious diseases. If, however, I observe and any unusual or significant hazard during my presence or participation, I will remove myself from participation and bring such to the attention of the nearest official immediately; and,
4. I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin, HEREBY RELEASE AND HOLD HARMLESS Autism on the Seas officers, officials, agents, volunteers, and/or employees, other participants, any person that we may come into contact with, sponsoring agencies, sponsors, advertisers, and if applicable, owners and lessors of premises used to conduct the event (“RELEASEES”), WITH RESPECT TO ANY AND ALL ILLNESS, DISABILITY, DEATH, or loss or damage to person or property, WHETHER ARISING FROM THE NEGLIGENCE OF RELEASEES OR OTHERWISE, to the fullest extent permitted by law.
Services Scope
Staff are not liable for continued volunteered services beyond original trip length, in the event the cruise lasts longer (in days) expected, but AotS would likely ask for additional volunteer services depending on the circumstances, etc., and conversely if the ship arrives early, continued volunteer services is expected until original trip length expires (if for example the ship and cruise ends at a different port and guests are put up in a hotel).

- Hotel & Room/Cabin details
Staff Information
Staff member understands and agrees that all information furnished to AotS may be shared by Autism on the Seas employees or representatives, Royal Caribbean International, Carnival Cruise Lines, Walt Disney World, or Disney Cruise Lines. Email addresses and cell phone numbers will be shared with all Staff Members for purposes of communicating prior to the cruise and on the day arriving to the port/hotel as necessary
Staff Liability Insurance
Staff are covered for liability under the Autism on the Seas insurance policy. For a copy of this insurance policy, please inquire
Staff Policies will be Provided
- Staff members will be provided with specific polices, rules and expectations after being contracted for each assignment.
- These policies will include personal hygiene, grooming and conduct (both for AotS and applicable cruise line/resorts policies)
- Staff members may contact the AotS office with any questions, concerns or issues with any policy provided from now and until the end of the cruise.
Staff Reporting / Relations
- Staff Member will report directly to the AotS Group Leader during the Cruise and to the AotS Staff Lead when the Group Leader is not present.
- Staff member understands that any issue with another volunteer staff person that is not immediately remedied, the staff member must bring the issue to the attention of the Group Leader.
HIPAA/CONFIDENTIAILTY (Volunteer/Contractor) Non-Disclosure AGREEMENT
This HIPAA/CONFIDENTIAILTY (volunteer/contractor/Staff Member) non-disclosure agreement (the “Agreement”) is made between the Volunteer/Contractor (Staff Member) whose name and email appear on this form and the (“Provider”) Autism on the Seas, LLC and is effective until the cruise/resort stay (stated on this form) responsibilities of this Volunteer/Contractor/Staff Member (“Staff Member”) are completed. The Agreement is intended to prevent the unauthorized disclosure of Confidential Information (as defined below) by the Staff Member. The parties agree as follows:
1. Personal Health Information
During the course of assignment, Staff Member may have access to personal health information (‘PHI”) relating to guests of Provider. PHI may consist of medical records, diagnosis related characteristics or any individually identifiable health information. PHI is protected by the Health Insurance Portability and Accountability Act (“HIPAA”). HIPAA permits access to PHI on a “need to know” basis. Therefore, unless authorization/access has been granted, any intentional accessing of PHI, or circumvention of PHI security protocols, is prohibited.
2. Confidential Information
Confidential Information” consists of PHI as well as proprietary information relating to Provider’s business, including but not limited to: personal information, diagnosis related characteristics, pictures of guests, billing, medical and financial records, revenues, identification and account numbers and names, PINs, and passwords, or all other information conveyed in writing, electronic means or in a discussion.
3. Non-Disclosure
Without Provider’s prior written consent, Staff Member will not: (a) disclose PHI/Confidential Information to any third party, whether electronically, orally, or in writing; (b) make or permit to be made copies or other reproductions of PHI/Confidential Information; (c) make any use of PHI/Confidential Information; or (d) use or disclose PHI/Confidential Information in violation of applicable law, including but not limited to HIPAA.
4. Return of Confidential Materials
Upon Provider’s request, Staff Member shall immediately return all original materials provided by Provider and any copies, notes or other documents in Staff Member’s possession pertaining to PHI/Confidential Information.
5. General Provisions
(a) Relationships. Nothing contained in this Agreement shall be deemed to constitute either party a partner, joint venturer or Staff Member of the other party for any purpose.
(b) Severability. If a court finds any provision of this Agreement invalid or unenforceable, the remainder of this Agreement shall be interpreted so as to best to effect the intent of the parties.
(c) Integration. This Agreement expresses the complete understanding of the parties with respect to the subject matter and supersedes all prior proposals, agreements, representations, and understandings. This Agreement may not be amended except in a writing signed by both parties.
(d) Waiver. The failure to exercise any right provided in this Agreement shall not be a waiver of prior or subsequent rights.
(e) Injunctive Relief. Any misappropriation of Confidential Information in violation of this Agreement may cause Provider irreparable harm, the amount of which may be difficult to ascertain, and therefore Staff Member agrees that Provider shall have the right to apply to a court of competent jurisdiction for an order enjoining any such further misappropriation and for such other relief as Provider deems appropriate. This right of Provider is to be in addition to the remedies otherwise available to Provider.
(f) Attorney Fees and Expenses. In a dispute arising out of or related to this Agreement, the prevailing party shall have the right to collect from the other party its reasonable attorney fees and costs and necessary expenditures.
(g) Governing Law. This Agreement shall be governed in accordance with the laws of the State of Connecticut
(h) Jurisdiction. The parties consent to the exclusive jurisdiction and venue of the federal and state courts located in Connecticut in any action arising out of or relating to this Agreement. The parties waive any other venue to which either party might be entitled by domicile or otherwise.
